The Supreme Court of India has done that agreed to hear the pleas of AAP leader Manish Sisodia on December 11 seeking relaxation in bail conditions in connection with the corruption and money laundering cases related to alcohol excise policy in Delhi.
Senior advocate Abhishek Singhvi, representing Sisodia, mentioned the case before a bench of Justices BR Gavai and KV Viswanathan. The court scheduled the hearing for December 11 and stated in response to the request “The day after tomorrow.”
The Supreme Court had granted bail to Sisodia on August 9 on the grounds that his prolonged detention of 17 months without trial had deprived him of his right to a speedy trial. The bail conditions stated that Sisodia had to report to the investigating officer every Monday and Thursday between 10 a.m. and 11 a.m. Singhvi said that Sisodia had appeared before the investigating officers 60 times.
Sisodia was arrested by the Central Bureau of Investigation (CBI) on February 26, 2023 for alleged irregularities in the formulation and implementation of the now scrapped Delhi Excise Policy 2021-2022. Subsequently, the Enforcement Directorate (ED) arrested him on March 9, 2023 in connection with the money laundering case. Sisodia resigned from the Delhi Cabinet on February 28, 2023, after his arrest.
In its August 9 ruling, the Supreme Court emphasized the principle that “bail is the rule and imprisonment the exception.” The court found that Sisodia was deprived of the right to a speedy trial due to his lengthy detention.
It also directed him to furnish a bail bond of Rs 10 lakh with two sureties of the same amount and surrender his passport before the special court. Moreover, the court has directed Sisodia not to influence witnesses or tamper with evidence.
The Delhi High Court had earlier rejected Sisodia’s bail pleas on May 21, leading to an appeal in the Supreme Court. The CBI and ED had opposed his bail applications.
